As a federally-funded agency, the NJTPA complies with the Freedom of Information Act (FOIA), which provides the public the right to request access to records. To request a record please email a completed NJTPA Records Request Form to the Custodian of Records at FOIA@njtpa.org.

Not all records are required to be released under the FOIA. Congress established nine exemptions from disclosure for certain categories of information to protect against certain harms, such as an invasion of personal privacy, or harm to law enforcement investigations. The FOIA authorizes agencies to withhold information when they reasonably foresee that disclosure would harm an interest protected by one of nine exemptions. They include:

  • Information related solely to the internal personnel rules and practices of an agency.
  • Information that is prohibited from disclosure by another federal law.
  • Trade secrets or commercial or financial information that is confidential or privileged.
  • Privileged communications within or between agencies, including those protected by the Deliberative Process Privilege, Attorney-Work Product Privilege and Attorney-Client Privilege
  • Information that, if disclosed, would invade another individual’s personal privacy.

Before releasing a contract into which a proposal has been incorporated, we will ask the submitter of the proposal for advice concerning any commercial information that may be contained in the proposal. We will consider that advice and, if we agree, we will redact that information before we release the documents to you. 

Please note that Federal law prohibits us from releasing Technical Proposals that have not been incorporated into a final contract. That law can be found at 41 U.S.C. §253b(m). 

If any information from a contract or contract records you requested is redacted, we will explain that in our final response to you. If you have any questions about the information that may have been redacted from the records you receive in response to a FOIA request, you are encouraged to contact the Custodian of Records.
